2. What we collect, and why
Visitors to this website
We collect your IP address, the pages you view, your device and browser type, and the page that referred you. We use this to keep the site working and secure, and — only if you consent — to measure the results of our advertising. Legal basis: our legitimate interest in a functioning, secure website, and your consent for advertising and analytics cookies.
People who contact us or book an intro call
We collect your name, email address, phone number, the content of your message, and your appointment details. We use this to answer you, schedule a call and advise you. Legal basis: taking steps at your request before entering into a contract.
Buying, selling, renting and letting clients
Depending on the service, we collect your contact and address details, your search criteria and budget, financing details, employment or income documents where a landlord or lender requires them, viewing and bidding history, our correspondence with you, and a copy or verified record of your identity document. We use this to carry out the assignment you have given us. Legal basis: performance of our contract with you, and compliance with our legal obligations.
People on our property alert lists
We collect your name, email address and search criteria so we can send you matching properties. Legal basis: your consent. You can unsubscribe at any time by replying to any of these emails.
3. Identity checks (Wwft)
As an estate agent we fall under the Dutch Money Laundering and Terrorist Financing (Prevention) Act (Wet ter voorkoming van witwassen en financieren van terrorisme, Wwft). This obliges us to establish and verify the identity of our clients, to carry out client due diligence, and in certain cases to report unusual transactions to FIU-Nederland. Where we are required to make such a report, the law prohibits us from informing you about it.
4. Who we share your data with
We share personal data only where it is necessary, and never sell it. Depending on your situation, recipients may include:
- our website hosting and backup providers;
- Microsoft, for our email and calendar;
- Calendly, for appointment booking;
- Google, for advertising measurement — only if you have consented to advertising cookies;
- Meta/WhatsApp, if you choose to contact us by WhatsApp;
- the NVM exchange, Realworks and Funda, where a property is listed or searched;
- civil-law notaries, mortgage advisors, valuers, landlords, and the agent on the other side of a transaction, where this is needed to complete your transaction;
- our accountant, and tax or supervisory authorities where the law requires it.
5. Transfers outside the EEA
Some of the providers above may process data in the United States. Those transfers take place under the EU-US Data Privacy Framework and/or the European Commission’s Standard Contractual Clauses.
6. How long we keep your data
- Enquiries that do not lead to an assignment: up to 2 years.
- Client files, including identification records: 5 years after the end of the assignment, as required by the Wwft.
- Invoices and accounting records: 7 years, as required by Dutch tax law.
- Property alert subscriptions: until you unsubscribe.
- Website and advertising cookies: as set out in our cookie policy.
7. Cookies
This website uses functional cookies that are always placed, and statistics and marketing cookies that are placed only after you consent. You can change or withdraw your choice at any time through the cookie settings on this site. Our cookie policy explains each cookie in detail.
8. Your rights
You have the right to access the personal data we hold about you, to have it corrected or erased, to restrict or object to its processing, to receive it in a portable format, and to withdraw any consent you have given. To exercise a right, email info@canalcityrealty.nl. We will respond within one month. We may ask you to confirm your identity first.
If you are not satisfied with how we handle your request, you can lodge a complaint with the Dutch Data Protection Authority, the Autoriteit Persoonsgegevens (autoriteitpersoonsgegevens.nl).
9. Security
This website is served over an encrypted connection. We keep access to client files limited to those who need it, use multi-factor authentication on our business accounts, and keep our systems up to date. If a data breach occurs that is likely to present a risk to you, we will inform you and the Autoriteit Persoonsgegevens as the law requires.
10. Changes to this policy
We may update this policy when our services or our tools change. The date at the top shows when it was last revised.
